Agreement

By agreeing to have us work on your devices or equipment, you are acknowledging that you have read and understand, and agree to the computer repair terms and conditions agreement below.

Binding

Our terms and services shall be considered a legal binding contract set forth in the State of ND.

The customer “You” have requested service from Valley TechPros “Us or We” to diagnose and service your device or equipment for a fee as set forth in the estimate/work order provided. A “device or equipment” can mean Laptop, printer, fax machine, monitor or any electronic device or system we agree to work on. Valley Techpros shall make all reasonable efforts to repair your device or equipment subject to availability of parts. Valley TechPros shall perform the repair using reasonable skill and or care. 

You Agree to These Repair Terms & Conditions

BY SIGNING THE WORK ORDER OR ACCEPING OF OUR LABOR YOU AGREE TO THESE REPAIR TERMS AND CONDITIONS.

You have requested service from Valley TechPros, to diagnose and service your device or equipment for a fee as set forth in the estimate/work order provided. A “device or equipment” can mean Laptop, Smartphone, Tablet, Server, PC, Xbox, PlayStation, camera, printer, fax machine, stereo, tv, monitor or any electronic device or system we check in and agree to work on. 

Right to Refuse Service

Valley TechPros retains the right to refuse service to anyone for any reason at any time. Refunds will not be given for refused service.

Discrimination

Valley TechPros has a ZERO tolerance policy for discrimination. Valley TechPros Employees, Contractors, Guests or Customers shall not discrimination against any Religion, Sex, Gender Identity, Sexual Preference, Race, Ethnicity, Marital Status, Political Affiliation or any other protected class In the State of ND or United States Government. 

Government ID Requirements

We may require a government issues ID for all Drop off, Pickups & Checks. We reserve the right to deny a Pickup or Transaction if a Valid ID is not Present.

Pickups

We reserve the right to restrict pickup of devices to the person or persons listed on the ticket unless other per-arrangements have been made. Devices may not be released without consent from person or persons listed on the ticket.

Personal Information

We collect personal information including but not limited to. Name, Phone, Address & Email for the use of tracking repairs & marketing. Please inform us if you would like any of this information deleted / destroyed.

Deposit

Valley TechPros requires a $75 NON-REFUNDABLE deposit on all repairs for all customers not under a agreement with us. Deposit will be used towards final labor costs for the repair. Deposit can not be used towards cost of supplies or parts.

PC, Mac & Computer Repair Warranty

Valley TechPros provides a 30-day guarantee for computer on repair services & 15 Days on all other items. We offer a 30 warranty on all NEW PC/Computer Parts. If your problem is not resolved, we can repair or replace the defective parts. We reserve the right to refuse any warranty claim. Once the device has left our possession new or old Virus, Damages, Cracks, or Misuse are not covered & will be considered a new repair. If after a repair, you experience problems which were not originally disclosed to prior to the initial repair, the problem is classified as new and unrelated & not covered by our warranty.

 

Other Electronics Warranty

All other electronic devices not classified as Computer, PC or Mac, are covered under our Electronics Warranty. Electronics are covered by a 15 day Labor warranty. Parts do not come with a warranty of any kind as most are used / refurbished parts. 

Battery Safety

Due to the nature of electronics batteries and risk of personal injury, danger, fires, or explosions if Valley TechPros discovers a damaged or bloated battery it will be replaced at your cost. Cost of battery and removal will be added to your final invoice. Valley TechPros cannot and shall not return a device with a damaged battery. if customer refuses battery replacement the device shall be held till such time the battery has been replaced.

Refurbished & Used  Parts

We do not warranty used or refurbished parts.

Replacement Parts

All parts will be replaced with like or similar parts. Store credit or cash will not be given.

 

We reserve the right to refuse any warranty claim

Data recovery, backup services & devices with liquid damage are exempt from any warranty or guarantee even after repair or service.

 

Manufacturer Warranty

Some services may void your manufacturer’s warranty. Some manufacturers provide exemptions for professional repair shops, though we cannot guarantee in any way that yours will, nor do we have a list of manufacturers who do provide such exceptions.  Any repairs or modifications to iPhones and other Apple Products WILL void your warranty. You understand and agree that we are not held liable for voiding your devices manufacturers warranty.

Liability

Valley TechPros shall not be held responsible for any damage unforeseen or otherwise before, during or after a repair. By repairing your device you are doing so at your own risk.

Unforseen Damages

A device that has been broken or damaged may incur unforeseen damages. including but not limited to damaged chips, Apple iPhone touch IC failure, cables or buttons. Valley TechPros shall not be responsible for any unforeseen damages. You may be required to pay any necessary fees required to complete the repair.

Accessories

We do not cover loss or damage to accessories or attached accessories that are not installed by the original manufacture. It may be necessary to remove these during a repair. We do not cover repair or replacement to accessories.

Water Proofing

It may be necessary to remove seals or films. We will make full effort to replace seals or films but cannot in anyway guarantee that your device will be water proof or resistant after repair.

Protection of Data

We are not responsible for any data loss & do not guarantee the protection of your personal data. You are required to back up your data. Valley TechPros DOES NOT service HIPPA, Government or Computers containing Social security numbers. It is your responsibility to inform us if you fall under these classifications.

Apple Repairs

We employ Apple Certified Technicians. Valley TechPros IS NOT an Authorized Apple Repair Provider. Apple Repairs performed by us may void any Apple Warranty.

Payments

All outstanding payments are due at time of pickup. we require pre-payment on special orders. WE DO NOT ACCEPT PERSONAL CHECKS. We may accept business checks All payments are final 

Payment for On-Site / Remote support must be paid within 15 days.A 10% late fee will be applied for every 30 days past due. 90 days past due will result in any open invoices being turned over to a collection agency

Returns, Exchanges & Refunds

We do not offer refunds. All payments are final. All accessory returns must be completed within 7 days for exchange or store credit if in original or unopened condition with proof of purchase. All sales on Mobile, Computer, Consumables & Screen Protectors are FINAL.

Bench Fee

A Minimum $75 bench fee will be applied to all  Computer, PC, Mac & Electronic.

Devices will not be released unless the bench fee has been paid.

Bench Fee totals may be adjusted at any time depending on difficulty or repair or diagnosis. 

Refunds

Valley TechPros does not issue refunds. 

Abandonment

Devices or equipment  left longer than 30 calendar days after the repair is completed are considered abandoned and become the property of Valley TechPros. If you wish to gain your property back you will be required to pay you current balance plus 15% of the repair cost of $50 whichever is greater. There is no guarantee the device or equipment will be available after 30 calendar days.

Duty to Inform

In the event we discovery any data or information deemed illegal under the laws of the United States or State of ND. Your Device will be released to the proper authorities without your consent.

Indemnification

You agree to indemnify, defend and hold harmless Dalan LLC Dba Valley Techpros and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Legal/Arbitration

This agreement shall be construed under the laws of the State of North Dakota. In the event any dispute arises under this agreement or in any manner concerning the subject matter thereof, the parties agree that any such dispute shall be subject to binding arbitration only, and the customer expressly waives any and all rights they may have to otherwise proceed with such dispute resolution in a court of law. Any and all binding arbitration proceedings shall be undertaken as “fast track” proceedings and shall only be commenced in Grand Forks County, North Dakota. Each party shall bear its own costs and expenses of such proceedings, including any and all resulting attorney fees; provided, however, that the prevailing party in such proceedings may have the right to recover attorney fees against the opposing party if such fees are otherwise recoverable in disputes of that type under the laws of the State of North Dakota. This paragraph is intended to be and shall be construed as a forum selection clause, and the parties agree to bound hereto.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Changes
